Article 32 hearing scheduled for Airman accused of sexual misconduct

An Article 32 hearing is scheduled for Monday, April 29, 2013, at the Academy for an Airman who had sexual misconduct charges preferred against him on March 28.

Airman 1st Class Aaron Stubbs is charged with one specification of aggravated sexual contact and one specification of abusive contact against a female enlisted Airman, in violation of Article 120 of the Uniform Code of Military Justice.

An Article 32 hearing is equivalent to a civilian grand jury proceeding. An investigating officer presides over an Article 32 hearing, and submits his or her report of the proceedings with recommendations to the 10th Air Base Wing Commander, as the special court martial convening authority. The 10th ABW commander will then decide whether to dismiss the case, recommend it go to a general court-martial, or dispose of the case through some other disciplinary or administrative action.

It must be emphasized that charges are merely accusations, and A1C Stubbs is presumed innocent until and unless proven guilty.
