Cadet to face Article 32 hearing March 14 Published March 13, 2013 U.S. AIR FORCE ACADEMY, Colo. -- A cadet will face an Article 32 hearing March 14 for a sexual assault charge preferred against him Jan. 31. Cadet 1st Class Benjamin York is charged with one specification of aggravated sexual assault, in violation of Article 120 of the Uniform Code of Military Justice. An Article 32 hearing is equivalent to a civilian grand jury proceeding. An investigating officer presides over the hearing and submits a report of the proceedings, along with recommendations, to the commandant of cadets as special court-martial convening authority. The commandant then decides whether to dismiss the case, recommend it go to a general court-martial or dispose of the case through other disciplinary or administrative action. The charges are merely accusations. The accused is presumed innocent until and unless proven guilty beyond a reasonable doubt.
